Divorces With a Minor Child or Minor Children

When you and your spouse get a divorce and have a minor child or children, the court will enter what is known as a Permanent Parenting Plan. The Permanent Parenting Plan accounts for the physical and legal custody of the minor child or children. The court’s rule in making a decision is first and foremost the best interest of the minor child. There are many statutory factors for the court to consider when awarding each parent time. Legal custody further involves decision-making among the parties to include healthcare, religious upbringing, education, extra-curricular activities and other considerations. Physical custody, who has the child on a day-to-day schedule, is one factor which affects child support. A parent’s income, number of days with the child, health insurance premiums, and daycare all contribute to the child support calculation determined by the Tennessee Child Support Guidelines’ calculator. The court will also look to the history of the upbringing of the child including who has been the primary parent for the majority of the child’s life. Sadly, there are circumstances where the negative behaviors of one parent will prevent that parent from full involvement with a minor child such as a criminal history, drug usage, or violence. Parents often wonder if their minor child will get to choose where they live and how much time they spend with the other parent. Under Tennessee law, the courts will consider the reasonable preference of a child that is over twelve (12) years of age and may choose to hear the reasonable preference of a child if he or she is under twelve (12) years of age so long as the court is convinced of the child’s maturity level. It is important to remember that the child’s preference is not a controlling factor for the courts. It too is one of the many statutory factors that the court will consider.
